Promo Rules

You may participate in the Promotion if you (i) are a registered user of SportStock, (ii) reside in Arizona, Idaho, or Utah, (iii) do not reside in any jurisdiction where use of SportStock is illegal or otherwise prohibited, (iv) are at least 18 years old and the age of majority in your jurisdiction, (v) are not on the U.S. Treasury Department’s list of Specially Designated Nationals, and (vi) are not an immediate family member of any of our employees, independent contractors, or agents. We may exclude access to the Promotion in any jurisdiction at any time, for any reason. The Promotion is void where prohibited.

The Promotion will end on (a) February 28, 2027 or (b) thirty (30) days after SportStock provides notice of termination, whichever occurs first. Our servers are the official time-keeping device of the Promotion. We reserve the right to begin a new Promotion after any current Promotion ends or is terminated. We further reserve the right to cancel, pause, modify, or suspend any part of or all the Promotion with immediate effect owing to events or circumstances outside of its reasonable control. Any event or circumstance impairing the proper functioning or integrity of the Promotion will be determined by SportStock, and any corrective action (to the extent necessary) will be determined and taken by SportStock in its sole discretion.

If you are eligible and have agreed to these Promo Rules, we will credit your account with:

• a specific number of Sports Chips which may vary and is prominently displayed on SportStock if you purchase certain packages of Gold Coins.
• 1 Sports Chips if you log on to SportStock and claim the free bonus, once per calendar day.
• 5 Sports Chips if you log on to SportStock and claim the free bonus, every day for seven consecutive calendar days.
• 5 Sports Chips if you mail a “Request Card” to 169 E 1200 S, Orem, Utah 84058 on a standard, unfolded, blank, lineless, legibly handwritten 4”x6” post card with the email address associated with your account, the full name shown on your government issued ID, your return residential address associated with your account, and the following statement: “I wish to receive Sports Chips, free of charge, in order to participate in the Promotion offered by SportStock. By submitting this request, I hereby declare that I have read, understood, and agree to be bound by SportStock’s Terms of Service and Promo Rules.” If your handwriting is illegible or your Request Card is otherwise noncompliant, as determined in our sole discretion, the Request Card will be void, and the Sports Chips will not be credited to your account. Only a single Request Card may be submitted per calendar day. Additional Request Cards postmarked on the same day will be disregarded and will not result in the award of Sports Chips.

We may change the balance of Sports Chips on your account at any time for good cause, including removing Sports Chips associated with accounts that have been inactive for more than sixty (60) days or in response to violations of these Promo Rules. Sports Chips may also be forfeited if your account is closed for good cause.

The odds of winning any Prizes are determined by a mix of factors including, but not limited to, the knowledge and skill of the user, the performance of the sports teams, the general public perception of the sports teams, and the purchases of the other participants in the Promotion. Therefore, there are no fixed odds of winning any Prizes.

Games played with Gold Coins do not provide an opportunity to win Prizes; only games played with Sports Chips provide an opportunity to win Prizes. The amount of Sports Chips required to obtain each Stock and the Prizes you are able to obtain by exchanging Stocks for Sports Chips is prominently displayed on SportStock.

Prize winners will be prominently displayed on SportStock at the time you exchange Stocks for Sports Chips. To exchange played-through Sports Chips for Prizes, you must meet the eligibility requirements above, you must pass the verification process below, you must provide valid and current banking information, and your details must match those on your account.

You cannot redeem Sports Chips for cash or other things of real-world value until your Sports Chips have been played through at least one (1) time, and you have at least twenty (20) sufficiently played-through Sports Chips. Prizes may be redeemed for cash or other thing of real-world value at a rate of one (1) Sports Chips to one (1) United States Dollar to the account which was used to buy Gold Coins or to a bank account or digital wallet selected by you, provided that you own such bank account or digital wallet.

The maximum amount of Sports Chips that can be redeemed at any given time may be adjusted or capped at any time, for any reason.

You are responsible for all taxes, fees, charges, and other costs associated with or otherwise incurred as a result of or in relation to the redemption of any Prize, including any shipping and handling fees which are prominently displayed on SportStock.

You understand and agree that (i) we do not provide any licensed or regulated financial services, (ii) we do not act as your broker, intermediary, agent, custodian, or advisor in any fiduciary capacity, (iii) your account is not a bank account, (iv) your account balance does not earn interest, (v) your account balance may not be returned or paid to you if we become insolvent, and (vi) your account balances and transactions are only reported to you through SportStock, and we are under no obligation to issue any other report regarding your account balance or transactions.

When you qualify for and request a withdrawal, we will issue payment to you in your selected payment method for any Prizes associated with your account during the preceding pay period, minus any processing fees based on your payment selection or otherwise associated with your account, provided you have met the minimum payment threshold. You are responsible for providing accurate bank account or payment method details identifying where the Prizes will be sent. You must own or control the account associated with your payment method, and you agree to provide us with such information as we may request to confirm your ownership or control. You will not receive a payment from us until you have met the minimum payment threshold. If we receive notice of any lien or encumbrance against your account, or if we reasonably suspect that a violation of these Terms of Service has occurred, we may suspend payments to you until such lien or encumbrance is satisfied or discharged, or until we have determined whether a violation has occurred. We may set off any liability, damages, costs, or expenses that we incur arising from or relating to your breach of these Terms of Service against any money that we owe to you under these Terms of Service. We may also adjust or deduct the monies transferred to your account for any reason, at any time, without advance warning or notice, including retroactively. The most common reasons for transfer adjustments include customer refunds, fraud, software malfunctions, conduct violations, third party liens, garnishments, and technical errors. You shall forfeit all Prizes associated with your account if, due to inaccurate, incomplete, or outdated account information provided by you, we are unable to issue a disbursement to you within six (6) months of the purchase of the license associated with the Prizes displayed on your account.

We are not responsible for determining any tax implications connected to your use of SportStock, and we make no representation as to the tax implications in any jurisdiction. We will not be responsible for any state or federal income tax withholding, unemployment contribution, workers compensation, Medicare / Medicaid, or any employment-related benefits.

You shall be responsible for payment of all taxes associated with your use of SportStock, including any purchases and Prizes associated with your account. You are solely responsible for declaring, bearing, and paying all taxes, duties, imposts, levies, tariffs, surcharges, and other amounts that might be due under any applicable law. You will be solely responsible for any penalties, claims, fines, punishments, and other liabilities arising from your nonpayment, underpayment, undue payment, or belated payment of any applicable tax associated with your use of SportStock.

You acknowledge that you are not our employee. If requested, you will provide us with a Social Security Number or Taxpayer Identification Number, so that an IRS form 1099 may be issued where required by law. You further agree to provide any additional tax-related information requested by us. Failure to provide such information to us may result in termination of these Terms of Service.

We utilize various third-party payment processors and gateways, and we reserve the right to contract with additional third-party payment processors and gateways in our sole discretion to process all payments associated with SportStock. Such third parties may impose additional terms and conditions governing payment processing. You are responsible for abiding by such terms. We further disclaim any liability associated with your violation of such terms.

You must promptly inform our third-party payment agents of all changes, including changes in your address, debit or credit card, and other banking information used in connection with payments through SportStock. You are responsible for any debit or credit card charge backs, dishonored checks, and any related fees that we incur with respect to your account, along with any additional fees or penalties imposed by our third-party payment agents.

We reserve the right to withhold or reverse any Prizes obtained while using Sports Chips obtained in relation to a purchase of Gold Coins that results in a chargeback or other reversal of payment.

We reserve the right to make changes at any time to our payment methods, including the addition of administrative or supplemental charges for any feature, with or without prior notice to you.

If you believe that we have paid you an insufficient amount for any activity associated with your account, please notify us of such error immediately. If you do not do so within thirty (30) days after such payment error first appears on any account statement, the payment in question will be deemed acceptable by you for all purposes, including resolution of inquiries made by or on behalf of your banking institution. You release us from all liabilities and claims of loss resulting from any error or discrepancy that is not reported within thirty (30) days of the bill or payment being rendered to you. These Terms of Service shall supplement and be in addition to any terms and conditions imposed by third party payment entities we engage to provide payment services. You are responsible for reviewing and complying with such entity’s terms and conditions in addition to those contained in these Terms of Service.

We prohibit and seek to prevent money laundering and the funding of criminal activities, and we have implemented internal security policies to monitor for and prevent money laundering. We may require you to provide certain identification, documents, or other information that we deem necessary for us to perform our Know Your Customer (“KYC”) verification procedures. If you submit a photo identification and verification image or video, you agree that we, or our third-party verification service providers, are authorized to collect, store, or maintain certain biometric information including a scan of your facial geometry. If you have not passed our KYC procedures, or if we suspect that you are engaged in money laundering, we may (i) prohibit you from creating an account, (ii) prevent you from using certain features, (iii) refuse to process your transactions, (iv) request additional information from you, or (v) suspend or terminate your account. The most common reasons for such actions include (i) your failure to provide any requested KYC information in a timely manner, (ii) your provision of fraudulent or incomplete account or payment information, (iii) one or more of your transactions being flagged, and (iv) your inclusion on OFAC’s list of Specially Designated Nationals and Blocked Persons or a similar sanctions or terrorism watch list. We may provide any evidence of your suspicious activities to financial regulators or law enforcement as deemed necessary by us. By transacting on SportStock, you represent and warrant that the funds are not sourced from any illegal source or the proceeds of any crime, and that you will not use any Prizes associated with your account in the commission of any crime.

Before you can redeem any Prizes, we may require you to sign certain forms, provide certain verification documentation and information, and pass certain KYC/AML procedures to our satisfaction. You are not entitled to any prize, even if the online screen indicates that you are a winner, unless and until your eligibility and the potential winning play has been verified by us, in our sole discretion, and you have provided all necessary forms, documentation, and information within seven (7) days of any request by us. While we may request additional evidence from you, we reserve the right to reject screenshots and other purported evidence of winning in our sole discretion.

If you fail to provide the requested documentation or information in a timely manner, if you fail to sign the required forms in a timely manner, if you fail to pass our KYC/AML procedures, if we determine that you have violated these Promo Rules, or if we determine that a technical error has occurred, the Prize will be null and void, and, except in the case of technical error outside your control, we may suspend or terminate your account. In the event that you are disqualified for any reason, SportStock may, in its sole discretion, reseed the Prize back into the Promotion.

If you violate our Terms of Service or these Promo Rules, we may terminate your account, any remaining balance of Sports Chips in the account will become non-withdrawable, and we may pursue any legal remedies or other appropriate actions against you, including civil, criminal, or injunctive relief, and forfeiture of any Prizes associated with your account.

If any Prize is no longer available for any reason after we have verified that you are eligible and have won said Prize, we will provide you with an option to receive cash or an alternate Prize with a fair market value at least equal to the fair market value of your original Prize.

You will not cheat or engage in platform manipulation, such as utilizing bots or other fraudulent means to artificially obtain or exchange Sports Chips, Stocks, or Prizes; tampering with the entry or redemption process; exploiting bugs; utilizing bots or other fraudulent means to gain an unfair advantage; failing to comply with the rules specific to any sweepstakes that you participate in; creating multiple accounts to play against; colluding with other users; paying or otherwise incentivizing other users to artificially improve your participation in the sweepstakes; or otherwise cooperating with other users in a way that unfairly impacts the outcome of the sweepstakes. You will not engage in unsportsmanlike conduct or in a disruptive manner. You will not otherwise undermine the operation of the Promotion. Any Sports Chips obtained or Prizes won through such activities, as determined in our sole discretion, will be null and void. If you engage in such activities or otherwise violate these Promo Rules, you will be disqualified from the Promotion, and we may seek damages from you to the fullest extent of the law. Our failure to enforce any provision of these Promo Rules shall not constitute a waiver of that provision.

Except where prohibited by law, your participation in the Promotion constitutes your consent to the use of your name, image, likeness, opinions, comments, photograph, voice, geographic data (i.e., hometown, U.S. State of residency), and winnings details by us or our agents for promotional purposes in any media, worldwide, without further payment, notice, or consideration to you.

If you post comments on SportStock, our social media pages, or elsewhere during any Promotion that are considered bullying, spiteful, disparaging, defamatory, or upsetting SportStock or to any user of SportStock, we may remove, request removal, or demand removal of your comments, and you will be disqualified from the Promotion.

You hereby agree to defend, release, hold harmless, and indemnify us and our parent companies, subsidiaries, affiliated companies, officers, directors, employees, independent contractors, agents, representatives, users, media partners, advertisers, content providers, suppliers, and related parties (“Released Parties”) from and against any and all claims, costs, expenses, liabilities, and damages (including reasonable attorney fees) arising out of or related to your use of SportStock or your participation in the Promotion.

To the extent permitted by law, the Released Parties are not responsible for:

• Any incorrect or inaccurate information, whether caused by you, coding error, or by any of the equipment or programming associated with or utilized in the Promotion.
• Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in computers, phone lines, or network hardware or software.
• Unauthorized human intervention in any part of the Promotion.
• Payment of any Prizes to any person who does not, in our sole determination, (i) meet the eligibility requirements, (ii) timely provide the required verification documentation and information, or (iii) pass certain KYC/AML procedures.
• Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt, use, or misuse of any Prize.

If for any reason your Sports Chips have been erroneously deleted, lost, or otherwise destroyed or corrupted due to our fault, your sole remedy is replacement of an equivalent amount of Sports Chips.

Under no circumstances will you be permitted to obtain, and you hereby waive all rights to claim punitive, incidental, or consequential damages, or any other damages or awards, including attorneys' fees, other than your actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion). You further waive all rights to have damages multiplied or increased.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY DESCRIBED ABOVE, SO THEY MAY NOT APPLY TO YOU.
